Who We Are
Backyard-AI LLC (“Backyard-AI”, “we”, “us”, “our”) provides AI training, advisory, and related services. This Privacy Policy explains how we collect, use, disclose, and protect personal information when you use our websites, online stores, and other services (collectively, the “Services”).

Notice at Collection (What We Collect & Why)
We may collect the following categories of personal information for the purposes listed below:
Identifiers (e.g., name, email, phone, IP address) – account setup, communications, security, and fraud prevention.
Commercial information (e.g., orders, cart, transaction details) – order processing, fulfillment, accounting.
Internet or network activity (e.g., page views, device/browser metadata) – site operations, performance, analytics, debugging.
Approximate geolocation – localization, analytics, fraud prevention.
User-generated content (e.g., messages, reviews, forms) – customer support, community features.
Employment-related information (for applicants) – recruiting and hiring.
Sensitive data only with choice/consent where required (e.g., precise geolocation). We do not intend to collect health data unless you voluntarily provide it in training or support interactions, and then only to the extent necessary to respond.
We use information to deliver and improve the Services, process payments and orders, personalize content, secure and debug systems, prevent fraud, comply with law, and communicate with you (including service notices and, where permitted, marketing—opt-out at any time).
Information We Collect
1) You Provide to Us
Account/contact details, billing and shipping details (processed by our payment provider), survey responses, customer support messages, event registrations, and job applications.
2) Collected Automatically
Device and usage data (IP address, device/browser type, pages viewed, timestamps, referring URLs) via cookies, pixels, and similar technologies.
3) From Third Parties
Payment processors, analytics and marketing vendors, anti-fraud/security providers, shipping/fulfillment partners, and (if enabled) social logins.
How We Use Information
Provide, maintain, personalize, and improve the Services.
Process orders and payments; fulfill and deliver products/services.
Authenticate, secure, prevent fraud, debug, and monitor performance.
Communicate about accounts, transactions, updates, and (with consent or as permitted) marketing.
Analyze usage and develop new features.
Comply with legal obligations and enforce agreements.
Software & SaaS-Specific Disclosures
In addition to website interactions, Backyard-AI LLC may offer downloadable software and software-as-a-service (SaaS) products. When you use our software or SaaS, we may process: (a) account and license data (e.g., organization, role, seats, license keys); (b) product usage and telemetry (feature use, performance metrics, crash logs, error reports, device/OS info); (c) configuration data (workspace/project names, settings, integration metadata); and (d) support artifacts you choose to send (logs, screenshots, files). We use this information to provide the services, ensure reliability and security, measure and improve performance, troubleshoot, and prevent abuse.
Analytics & experiments. We may use privacy-preserving analytics, feature flags, and limited A/B tests to understand engagement and improve product quality. Where required, you can opt out of analytics, and organizational admins may control certain collection at the workspace level.
Admin controls. For business customers, your organization’s administrators may control access, provisioning, retention, and export of workspace data. If you are an end user of a Backyard-AI customer, your data may be governed by your organization’s policies. Please contact your organization for requests about workspace content.
AI Features, Prompts & Content Handling
Some Services include AI-powered features (assistants, agents, summarizers). To operate these features, we may process your prompts, inputs, and outputs and generate logs for abuse prevention, quality, and security. Limited human review may occur under confidentiality obligations to investigate abuse or diagnose issues. Please do not include confidential or sensitive information beyond what is necessary.
Model training. Backyard-AI does not use your content to train our foundation/partner models for generalized improvements unless you give us express consent (or your organization opts in by agreement). We may use aggregated or de-identified data for analytics and service improvement consistent with applicable law.
Role as Service Provider/Processor
We act as an independent business (controller) for our direct website and marketing operations. When providing Services to business customers (e.g., managed implementations or SaaS workspaces), we generally act as a service provider/processor processing personal information on our customer’s instructions and subject to a written data processing agreement (DPA). If you are an end user of a business customer, please direct rights requests about workspace data to your organization.
Payment Processing
Payments are processed by our third-party payment processors (e.g., Stripe). We receive limited payment metadata (e.g., amount, date, last4) and do not store full credit card numbers. Your payment information is handled according to the processor’s policies.
Health Information & HIPAA
Backyard-AI LLC is not a covered entity or business associate under HIPAA for our standard Services and does not intend to receive protected health information (PHI). Do not submit PHI to the Services unless we have executed a separate Business Associate Agreement (BAA) expressly permitting such processing.
Subprocessors
We rely on vetted vendors to help us deliver the Services (hosting, storage, email/SMS, analytics, support, security). A current list of significant subprocessors is available at www.backyard-ai.com/subprocessors. We require appropriate data-protection commitments from these vendors.
Cookies & Similar Technologies
We use cookies/SDKs for essential operations, performance and analytics, personalization, and advertising measurement. Manage cookies in your browser settings and (where available) via our cookie preferences.
When We Share Information
Service providers / processors (hosting, payments, analytics, email/SMS, support, shipping, security, auditing) under contracts requiring use only on our instructions and appropriate safeguards.
Business transfers (e.g., merger, acquisition, reorganization).
Legal compliance (to comply with law, respond to lawful requests, enforce terms, protect rights and safety).
Advertising/analytics partners if used; see Your Privacy Rights to opt out where required.
Sale or Sharing of Personal Information
Some state laws define “sale” broadly and regulate “sharing” for cross-context behavioral advertising. We do not sell personal information for money. If our use of advertising or analytics is deemed a “sale” or “share,” you may opt out using Do Not Sell or Share My Personal Information and your browser or device controls. You may also send a rights request as described below.
Your Privacy Rights & Choices
Depending on your state, you may have the right to:
Access the personal information we maintain about you.
Correct inaccurate personal information.
Delete personal information.
Portability (receive a copy in a portable format).
Opt out of (a) sale or sharing; (b) targeted advertising; and (c) certain profiling with legal or similarly significant effects.
Appeal a denial (where required).
How to exercise your rights: submit a request via our privacy request form or email nick@backyard-ai.com. We will verify your identity reasonably related to the request. Authorized agents may submit requests as allowed by law.
Opt-out preference signals (GPC): Where required, we recognize Global Privacy Control signals as an opt-out of sale/sharing for the browser that sends the signal.
Tennessee Addendum (TIPA)
If you reside in Tennessee, the Tennessee Information Protection Act (“TIPA”) provides rights substantially similar to those listed above (access, correction, deletion, portability, and opt-out of targeted advertising, sale, and certain profiling). We will not process sensitive data about you without consent (or in compliance with COPPA for known children).
Applicability thresholds: TIPA generally applies to businesses with over $25 million in revenue and that either (i) process data of at least 175,000 Tennessee consumers in a year, or (ii) process data of 25,000 consumers and derive 50%+ of gross revenue from the sale of personal information. Effective: July 1, 2025. The Tennessee Attorney General exclusively enforces TIPA; there is no private right of action. Maintaining a written privacy program aligned to the NIST Privacy Framework can provide an affirmative defense.
California Addendum (CCPA/CPRA)
California residents have additional rights under the California Consumer Privacy Act, as amended by the CPRA, including the right to know categories/specific pieces, sources, purposes, and categories of third parties; to delete and correct; to opt out of sale or sharing; to limit use/disclosure of sensitive personal information; and to be free from discrimination for exercising rights. Where applicable, we provide: Do Not Sell or Share My Personal Information and Limit the Use of My Sensitive Personal Information.
Children’s Data
Our Services are not directed to children under 13. We do not knowingly collect personal information from children under 13 without verifiable parental consent. If you believe a child has provided personal information to us, contact us and we will take appropriate steps to delete it.
Data Security
We use administrative, technical, and physical safeguards designed to protect personal information (e.g., encryption in transit, access controls, least-privilege). No method of transmission or storage is 100% secure.
Data Retention
We retain personal information as long as necessary to provide the Services, comply with legal obligations (including tax and accounting), resolve disputes, and enforce agreements. We apply documented retention schedules and delete or de-identify data when no longer needed.
International Visitors
Our Services are intended for users in the United States. If you access the Services from outside the U.S., your information may be processed in the U.S., which may have different data-protection laws than your jurisdiction.
Third-Party Links & Social Features
Our Services may link to third-party sites, apps, or features. Their privacy practices are governed by their own policies.
Your Choices
Marketing emails/SMS: Opt out via unsubscribe links or by contacting us.
Cookies/Ads: Use our cookie preferences (if available) and your browser/device settings.
Do Not Track: We do not respond to DNT signals due to industry variability.

Changes to This Policy
We may update this Policy from time to time. We will post the updated version with a new effective date. Material changes will be communicated as required by law.
